VEHICLE COMPLIANCE OFFICER HIRED
Gary McBride, Hampshire County's
Vehicle Compliance Officer
Gary McBride has begun employment as the Hampshire County Vehicle Compliance Officer. Ofc. McBride’s will be
enforcing violations of residents who have moved into the County and failed to obtain a West Virginia registration.

This has been a sore spot for a lot of County residence for many years. With the cooperation of the County
Commission, Prosecutor’s Office, Assessor’s Office and Sheriff’s Office we have high hopes that this will drastically
decrease the amount of residence living in Hampshire County who benefit from services, but fail to pay personal
property taxes on their vehicles and benefit from lower insurance premiums that other residents are paying. Ofc.
McBride is considered a co-employee between the County Commission, Prosecutor, Assessor and Sheriff.

State Law provides 30 days for new residents to obtain West Virginia registration. Once a notice is placed on vehicle
the owner must comply with the posted notice within 15 days. We will be looking to the citizens of Hampshire County
in an effort to tackle this ongoing problem. We ask that you submit tips by calling the Sheriff’s Office 24 hour line at
822-3894 or you can submit tips to the Assessor’s Office at 822-3326 from 9AM to 4PM Monday thru Friday.

The following are criteria that State Law allows for officials to consider when determining whether or not a person is
considered a resident of this State:

1.        The person is registered to vote in this State
2.        The person has a child registered in a School of this State or registered to provide home schooling to their
         child in this State.
3.        The person is receiving public assistance from this State.
4.        The person resides or has continuously remained in this state for a period exceeding thirty days, except for
         infrequent brief absences.
5.        The person has accepted employment or engages in trade, profession or occupation within this state, except
         that this does not include a person who is commuting from the person’s residence in another state or whose
         employment is seasonal or temporary, not exceeding thirty days.
6.        The person has filed for a homestead tax exemption on property in this state.
7.        The person subscribes to public utilities in this state in his or her own name
8.        The person receives his or her mail in this state pursuant to verification from the United States postal service.

A person may only have to meet one of these criteria to be considered a resident of this State.
When Ofc. McBride receives a legitimate complaint he will respond to the location of the reported violation and he
will post a notice on the suspect’s vehicle and after the notice is posted the vehicle owner must contact the
Assessor's Office with 15 days of receiving the notice.

Failure to contact the Assessor’s Office and comply with the notice will result in Ofc. McBride submitting a criminal
complaint to the Hampshire County Magistrate’s Office requesting a criminal summons so that the suspect must
appear in Court for the matter to go before a Judge.

We are also hoping that vehicle owner’s who are in violation of this Law will take it upon themselves to correct the
violation since the public is being made aware that we now have an Officer who will be out looking for these types of
violations
